T.0 General Terms – All Users

T.0.1 Definitions

NFT: Non Fungible Token

Qualified Educational Institution: means a public or private school, tutorial or learning center that has been accredited by an authorized governmental agency within its applicable level and has the primary purpose of teaching its enrolled students.

Ricciwawa Content: all content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music on and “look and feel” of the Services, and all intellectual property rights related thereto that are either owned or licensed by Makebell,

User: A user is anyone who access the Services. Users include, but are not limited to:

The above designations are not mutually exclusive, for example a Parent can also be a Creator.

T.1 Your Relationship With Us

Welcome to Ricciwawa (the “Platform”), which is provided by Makebell Ltd.

You are reading the terms of service (the “Terms”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform and our related websites, services, applications, products and content (collectively, the “Services”). Our Services are provided for private, non-commercial use. For purposes of these Terms, “you” and “your” means you as the user of the Services.

The Terms form a legally binding agreement between you and us. Please take the time to read them carefully.

T.2 Accepting the Terms

By accessing or using our Services, you confirm that you can form a binding contract with Makebell, that you accept these Terms and that you agree to comply with them.

2.1 Entire Agreement

You agree that these Terms are the complete and exclusive statement of the mutual understanding between you and us, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement and that your access to and use of our Services is also subject to our:

You can accept the Terms by accessing or using our Services. You understand and agree that we will treat your access or use of the Services as acceptance of the Terms from that point onwards.

You should print off or save a local copy of the Terms for your records.

T.3 Your Account with Us

To access or use some of our Services, you must create an account with us.

T.3.1 Account creation

When you create this account, you must provide accurate and up-to-date information. It is important that you maintain and promptly update your details and any other information you provide to us, to keep such information current and complete.

To create an account you affirm that you have not been previously suspended or removed from the Services and are:

No joint venture: You also acknowledge and agree that you are not a joint venture of Makebell Limited, and you do not have any authority of any kind to bind us in any respect whatsoever. 

No conflict of interest: You also acknowledge and agree that you are not an employee, agent, or partner of Makebell Limited, and you do not have any authority of any kind to bind us in any respect whatsoever. 

T.3.2 Access as a Business or entity

If you are accessing or using the Services on behalf of a business or entity, then (a) “you” and “your” includes you and that business or entity, (b) you represent and warrant that you are an authorized representative of the business or entity with the authority to bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf, and (c) your business or entity is legally and financially responsible for your access or use of the Services as well as for the access or use of your account by others affiliated with your entity, including any employees, agents or contractors.

T.3.3 Educator’s Additional Terms of Use

As a safety precaution Educators may be asked to provide us with proof of their teaching certification and employment at a school.

In addition to these Terms of Use, if you are an Educator using Ricciwawa, you acknowledge and agree that:

The Term of a Ricciwawa account for an Educator will start on the date access is granted and end on the earliest of:

T.3.4 Your responsibilities

It is important that you keep your account password confidential and that you do not disclose it to any third party. If you know or suspect that any third party knows your password or has accessed your account, you must notify us immediately at: info@ricciwawa.com.

You agree that you are solely responsible (to us and to others) for the activity that occurs under your account.

You must immediately notify us of any unauthorized uses of your account or any other breaches of security. Makebell will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

T.3.4.1What you should do

As a user, you can help prevent unauthorized access to your account and information by choosing a strong and unique password which is stored in a password manager. If you have any questions about the security of your personal information, you can contact us at info@ricciwawa.com.

T.3.4.2 Security experts or researchers

If you are a security expert or researcher and you believe that you have discovered a security-related issue with the Services, we appreciate your help in disclosing the issue to us responsibly.

T.3.5 Creators

Please refer to the Creator Agreement for additional terms applicable to Creators

T.3.6 Subscribers

Anyone can become a Subscriber to one or more Creator(s).

To pay for Creator content provided on a fee basis, simply add your preferred payment method.

We are not required to allow you to be a Subscriber of any particular Creator. Creators’ memberships vary and we have limited control over the quality and specific offerings.

T.3.6.1 Screening of Creator

We attempt to screen for fraudulent Creator content, but cannot guarantee the identity of Creators or the validity of any claims they make. We appreciate your help reporting suspicious Creator pages so we can keep the Services safe.

T.3.7 Disabling of your account

We reserve the right to disable your user account at any time, including if you have failed to comply with any of the provisions of these Terms or our Community Guidelines, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third party rights, violate any applicable laws or regulations.

T.3.7.1 Hacked Accounts

Makebell reserves the right to terminate, suspend or restrict your access to any Account(s) if there is reasonable suspicion by us that the person logged into your Account(s) is not you or if we suspect that the Account(s) have been or will be used for any illegal, fraudulent, or unauthorized purposes. Under no circumstances shall Makebell or indemnified persons in accordance with these Terms be responsible or liable for any direct or indirect losses (including loss of profits, business or opportunities), damages or costs suffered by you or any other person or entity due to any such termination, suspension or restriction of access to any Account(s).

T.3.7.2 Unsubscribe from the Services

If you no longer want to use our Services again, and would like your account deleted, contact us at: info@ricciwawa.com. We will provide you with further assistance and guide you through the process. Once you choose to delete your account, you will not be able to reactivate your account or retrieve any of the content or information you have added.

T.4 Acceptable use

Your access to and use of the Services is subject to these Terms and all applicable laws and regulations.

T.4.1 Prohibited Activities

Please do not engage in any behavior that endangers the security of our website and users. Below are some examples of things you should not do on the Platform or Services.

T.4.1.1 Legal competency:

You may not access or use the Services or the Platform if you are not fully able and legally competent to agree to these Terms or lack permission from a Parent, Guardian or Educator.

T.4.1.2 Unauthorized copies, Reverse engineering:

You may not make unauthorised copies, modify, adapt, translate, reverse engineer, disassemble, decompile or create any derivative works of the Services or any content included therein, including any files, tables or documentation (or any portion thereof) or determine or attempt to determine any source code, algorithms, methods or techniques embodied by the Services or any derivative works thereof.

T.4.1.3 Distribution/license/transfer/sale of the Services or derivative works

You may not distribute, license, transfer, or sell, in whole or in part, any of the Services or any derivative works thereof.

T.4.1.4 Commercial usage:

You may not:

T.4.1.5 Operational Interference

You may not interfere with or attempt to interfere with the proper working of the Services, disrupt our website or any networks connected to the Services, or bypass any measures we may use to prevent or restrict access to the Services.

You may not use the Services in a manner that may create a conflict of interest or undermine the purposes of the Services, such as trading reviews with other users or writing or soliciting fake reviews.

T.4.1.6 Scraping/data mining

You may not crawl, scrape or otherwise index information on the Platform or made available through the Services or use automated scripts to collect information from or otherwise interact with the Services without our prior written permission.

T.4.1.7 Impersonation:

You may not:

T.4.1.8 Intimidation or harassment

You may not intimidate or harass another, or promote sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

T.4.1.8 Upload restrictions

You may not use the Services to upload, transmit, distribute, store or otherwise make available in any way:

In addition to the above, your access to and use of the Services must, at all times, be compliant with our Community Guidelines.

T.4.2 Teams

Certain portions of the Services may allow you to create or contribute to group accounts (“Team”). Access to a Team will be made available only to those Users who are authorized by the Controller of the Team (“Team Owner”). The Team Owner will be responsible for adding Users to the Team, for managing permissions for authorized Users, and otherwise for managing the account as set forth in this Agreement.

The Team Owner may contact Makebell to assign a new Team Owner. Makebell will act on the directions of the Team Owner with respect to any re-assignment of ownership and the deletion and retention of Content within the Team.

T.4.3 Printouts of Creator or other Content

In some countries, you may be eligible to order prints of Creator or other Ricciwawa Content as part of the Services subject to these terms (“Print Services”), and may also be subject to the print partner’s terms (if noted when placing your order).

Makebell may engage third party supplies who will be responsible for completing your Print Services order once you submit a print order using the Service. We do not control these third party suppliers and your order may, from time to time, be affected by circumstances outside of Makebell’s control. If you experience any issues, please contact us at info@ricciwawa.com. Please do not provide our third party suppliers with your personal information at any time.

You may order prints of Creator or other Ricciwawa Content at your own cost. Unfortunately, we cannot guarantee delivery times for Print Services orders. If we provide you with a delivery time, it is an estimate only and we are not responsible or liable for any delays with shipping. You agree to hold harmless Makebell and its third party suppliers for any loss, cost or expense that you incur in connection with your use of our Print Services.

By printing Creator or other Ricciwawa Content using our Print Services, you agree to take steps to verify that the Creator or other Ricciwawa Content does not contain or consist of anything that is prohibited under these terms, the print partner’s terms (if applicable) or is otherwise unlawful. You agree that this is not the responsibility of Makebell or its third party suppliers, despite Makebell and its third party suppliers having the right to refuse your order (which is a right you acknowledge).

T.5 Intellectual Property Rights

We respect intellectual property rights and ask you to do the same. As a condition of your access to and use of the Services, you agree not to use the Services to infringe on any intellectual property rights in accordance with our Intellectual Property Policy. We reserve the right, with or without notice, at any time and in our sole discretion to block access to and/or terminate the accounts of any user who infringes or is alleged to infringe any copyrights or other intellectual property rights

T.6 Privacy

Makebell takes privacy very seriously. If you store personal or sensitive information provided by or collected from Ricciwawa users, you must do so securely and only for as long as it is needed.  

You may not collect from a user via the Services or Platform or any other method any information -- personally identifiable or not -- beyond what Makebell is permitted to collect from a user under its own Privacy Policy.

You are solely responsible for complying with any laws and regulations that apply to user information.

Consistent with our Privacy Policy, we collect certain data on how Subscribers engage with Creator content. We may share, at our sole discretion, some of this information with you. You agree that Makebell is under no obligation to share this data with you.

T.7 Indemnity

You agree to defend, indemnify, and hold harmless Makebell, its parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.

T.8 Content

T.8.1 Ricciwawa Content

As between you and Makebell, all content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music on and “look and feel” of the Services, and all intellectual property rights related thereto (the “Ricciwawa Content”), are either owned or licensed by Makebell, it being understood that you or your licensors will own any Content (as defined below) you upload or transmit through the Services. Use of the Ricciwawa Content or materials on the Services for any purpose not expressly permitted by these Terms is strictly prohibited. Such content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever without our or, where applicable, our licensors’ prior written consent. We and our licensors reserve all rights not expressly granted in and to their content.

T.8.1.1 Acknowledgement of our rights

You acknowledge and agree that we may generate revenues, increase goodwill or otherwise increase our value from your use of the Services, including, by way of example and not limitation, through the sale of advertising, sponsorships, promotions, and usage data, and except as specifically permitted by us in these Terms or in another agreement you enter into with us, you will have no right to share in any such revenue, goodwill or value whatsoever. You further acknowledge that, except as specifically permitted by us in these Terms or in another agreement you enter into with us, you (i) have no right to receive any income or other consideration from any Content (defined below) or your use of any musical works, sound recordings or audiovisual clips made available to you on or through the Services, including in any Content created by you, and (ii) are prohibited from exercising any rights to monetize or obtain consideration from any Content within the Services or on any third party service (e.g., you cannot claim Content that has been uploaded to a social media platform such as YouTube for monetization).

T.8.1.2 License Terms

Subject to the terms and conditions of the Terms, you are hereby granted a non-exclusive, limited, non-transferable, non-sub licensable, revocable, worldwide license to access and use the Services, including to download the Platform on a permitted device, and to access the Ricciwawa Content solely for your personal, non-commercial use through your use of the Services and solely in compliance with these Terms. Makebell reserves all rights not expressly granted herein in the Services and the Ricciwawa Content. You acknowledge and agree that Makebell may terminate this license at any time for any reason or no reason.


T.8.1.3 Caveat Emptor

You acknowledge and agree that when you view content provided by others on the Services, you are doing so at your own risk. The content on our Services is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Services.

T.8.1.4 No representations, warranties or guarantees

We make no representations, warranties or guarantees, whether express or implied, that any Ricciwawa Content (including Content from Creators) is accurate, complete or up to date. Where our Services contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. You acknowledge that we have no obligation to pre-screen, monitor, review, or edit any content posted by you and other users on the Services (including Content from Creators).

T.8.2 Your Content

T.8.2.1 Creation of Content

Users create their Content by entering or scanning text and adding additional elements including but not limited to text, photographs, user videos, sound recordings or musical works. Users may also overlay music, graphics, stickers, and other elements provided by Makebell or Ricciwawa (“Ricciwawa or Makebell elements”) onto this Content and transmit this Content through the services.

A User’s Content may incorporate ambient noise.

Users of the services may also extract all or any portion of Content created by another user to produce additional Content, including collaborative Content with other users that combine and intersperse Content generated by more than one user.

T.8.2.2 Approval and Representation

The information and materials in the Content, including Content that incorporates Ricciwawa or Makebell elements, is not been verified or approved by us. The views expressed by other users on the services (including through use of the virtual gifts) do not represent our views or values.

T.8.2.3 Compliance with standards

Whenever you access or use a feature that allows you to upload or transmit Content through the services or to make contact with other users of the services, you must comply with the standards set out in these terms.

You may also choose to upload or transmit your Content, images or recordings of your Content on sites or platforms hosted by third parties. if you decide to do this, you must comply with their content guidelines as well as with the standards set out in these Terms.

You warrant that any such contribution complies with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

T.8.2.4 Content is non-confidential, non-proprietary

Any Content will be considered non-confidential and non-proprietary.

You must not post any Content on or through the services or transmit to us any Content that you consider to be confidential or proprietary.

When you submit Content through the services, you agree and represent that you own that Content, or you have received all necessary permissions, clearances from, or are authorised by, the owner of any part of the Content to submit it to the services, to transmit it from the services to other third party platforms, and/or adopt any third party Content.

If you only own the rights in and to a sound recording, but not to the underlying musical works embodied in such sound recordings, then you must not incorporate such sound recordings in Content you post to the services unless you have all permissions, clearances from, or are authorised by, the owner of any part of the Content to submit it to the services

T.8.2.5 Copyright ownership

You or the owner of your Content still own the copyright in Content sent to us, but by submitting Content via the services, you hereby grant us an unconditional irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide licence to use, modify, adapt, reproduce, make derivative works of, publish and/or transmit, and/or distribute and to authorise other users of the services and other third-parties to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish and/or transmit your Content in any format and on any platform, either now known or hereinafter invented.

You further grant us a royalty-free license to use your user name, image, voice, and likeness to identify you as the source of any of your Content.

T.8.2.6 Through-to-the-audience rights

All of the rights you grant in your Content in these terms are provided on a through-to-the-audience basis, meaning the owners or operators of third party services will not have any separate liability to you or any other third party for Content posted or used on such third party service via the services.

T.8.2.7 Waiver of rights to Content. 

By submitting Content to or through the Services, you waive any rights to prior inspection or approval of any marketing or promotional materials related to such Content. You also waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection with your Content, or any portion thereof.

To the extent any moral rights are not transferable or assignable, you hereby waive and agree never to assert any and all moral rights, or to support, maintain or permit any action based on any moral rights that you may have in or with respect to any Content you post to or through the Services.

T.8.2.8 Disclosure where violation of IP Rights is claimed

We also have the right to disclose your identity to any third party who is claiming that any Content posted or uploaded by you to our services constitutes a violation of their intellectual property rights, or of their right to privacy.

T.8.2.9. Removal of infringing material

Makebell takes reasonable measures to expeditiously remove from our services any infringing material that we become aware of. It is Makebell’s policy, in appropriate circumstances and at its discretion, to disable or terminate the accounts of users of the services who repeatedly infringe copyrights or intellectual property rights of others

T.8.2.10 Our rights

We, or authorized third parties, reserve the right to cut, crop, edit or refuse to publish, your Content at our or their sole discretion. We have the right to remove, disallow, block or delete any posting you make on our services if, in our opinion, your post does not comply with the Content standards set out at “your access to and use of our services” above.

In addition, we have the right – but not the obligation – in our sole discretion to remove, disallow, block or delete any Content (i) that we consider to violate these terms, or (ii) in response to complaints from other users or third parties, with or without notice and without any liability to you. as a result, we recommend that you save copies of any Content that you post to the services on your personal device(s) in the event that you want to ensure that you have permanent access to copies of such Content. we do not guarantee the accuracy, integrity, appropriateness or quality of any Content, and under no circumstances will we be liable in any way for any Content.

T.8.2.11 Access to your Content

You control whether your Content is made publicly available on the services to all other users of the services or only available to people you approve.

T.8.2.12 Our liability

We accept no liability in respect of any Content submitted by users and published by us or by authorised third parties.

T.8.2.13 New features

While our own staff is continually working to develop and evaluate our own product ideas and features, we pride ourselves on paying close attention to the interests, feedback, comments, and suggestions we receive from the user community. If you choose to contribute by sending us or our employees any ideas for products, services, features, modifications, enhancements, Content, refinements, technologies, Content offerings (such as audio, visual, games, or other types of Content), promotions, strategies, or product/feature names, or any related documentation, artwork, computer code, diagrams, or other materials (collectively “feedback”), then regardless of what your accompanying communication may say, the following terms will apply, so that future misunderstandings can be avoided. accordingly, by sending feedback to us, you agree that:

  1. Makebell has no obligation to review, consider, or implement your feedback, or to return to you all or part of any feedback for any reason;

  2. Feedback is provided on a non-confidential basis, and we are not under any obligation to keep any feedback you send confidential or to refrain from using or disclosing it in any way; and

  3. You irrevocably grant us perpetual and unlimited permission to reproduce, distribute, create derivative works of, modify, publicly perform (including on a through-to-the-audience basis), communicate to the public, make available, publicly display, and otherwise use and exploit the feedback and derivatives thereof for any purpose and without restriction, free of charge and without attribution of any kind, including by making, using, selling, offering for sale, importing, and promoting commercial products and services that incorporate or embody feedback, whether in whole or in part, and whether as provided or as modified.


Nothing in these terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a consumer.

The services are provided “as is” and we make no warranty or representation to you with respect to them. in particular we do not represent or warrant to you that:

No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the services except to the extent that they are expressly set out in the terms. We may change, suspend, withdraw or restrict the availability of all or any part of our platform for business and operational reasons at any time without notice.


We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content).

We cannot predict when issues might arise with Ricciwawa. Accordingly,











11. Other Terms

a. Applicable Law and Jurisdiction. These Terms, their subject matter and their formation, are governed by the laws of Hong Kong.

b. Arbitration: Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity or termination of these Terms, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (“HKIAC”) in accordance with the Arbitration Rules of the Hong Kong International Arbitration Centre ("HKIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Hong Kong. The Tribunal shall consist of three (3) arbitrators. The language of the arbitration shall be English.

c. Open Source. The Platform contains certain open source software. Each item of open source software is subject to its own applicable license terms.

c. Entire Agreement. These Terms (including the Privacy Policy and the Intellectual Property Policy) constitute the whole legal agreement between you and Makebell and govern your use of the Services and completely replace any prior agreements between you and Makebell in relation to the Services.

d. Links. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our Services in any website that is not owned by you. The website in which you are linking must comply in all respects with the content standards set out at “Your Access to and Use of Our Services” above. We reserve the right to withdraw linking permission without notice.

e. Age Limit. The Services are only for people 13 years old and over By using the Services, you confirm that you are over the relevant age specified herein. If we learn that someone under the relevant age specified above is using the Services, we will terminate that user’s account.

f. No Waiver. Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.

g. Security. We do not guarantee that our Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our Services. You should use your own virus protection software.

h. Severability. If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms, and the remaining provisions of the Terms will continue to be valid and enforceable.

i. Survival: You agree that the terms under the heading “Privacy”, “Acceptable Use”, “Indemnity”, “Exclusion of Warranties”, “Limitation of Liability”, “No Joint Venture”, “Severability”, “Arbitration”, and “Entire Agreement”, and any payment obligations incurred shall survive termination of this Agreement.

Community Guidelines

CG.1 Introduction

As a Makebell user, you are responsible for the content you post.
Makebell's mission is to inspire creativity and bring joy. We are building a global community where people can create and share, discover the world around them, and connect with others across the globe. As we grow, we are committed to maintaining a supportive environment for our community. Our Community Guidelines define a set of norms and common code of conduct for Makebell; they provide guidance on what is and is not allowed to make a welcoming space for everyone.
At Makebell, we prioritize safety, diversity, inclusion, and authenticity. We encourage creators to celebrate what makes them unique and viewers to engage in what inspires them; and we believe that a safe environment helps everyone express themselves openly. We deeply value the global nature of our community, and we strive to take into account the breadth of cultural norms where we operate. We also aim to cultivate an environment for genuine interactions by only allowing authentic content on Makebell.
Our Community Guidelines apply to everyone and to everything on Makebell.
We will remove any content that violates our Community Guidelines. Individuals are notified of our decisions and can appeal if they believe no violation has occurred. We will suspend or ban accounts and/or devices that are involved in severe or repeated violations; we will consider information available on other platforms and offline in these decisions. When warranted, we will report the accounts to relevant legal authorities.
In consultation with relevant stakeholders, we update our Community Guidelines from time to time to evolve alongside new behaviors and risks, as part of our commitment to keeping Makebell a safe place for creativity and joy.

CG.2 Violence

CG.2.1 Violent extremism

We take a firm stance against enabling violence on or off Makebell.
We do not allow people to use our platform to threaten or incite violence, or to promote dangerous individuals or organizations.
We do not allow individuals or organizations on our platform who promote or are engaged in violence
When warranted, we will report threats to relevant legal authorities. To effectively protect our community, we may consider information available on other platforms and offline to identify violent and extremist individuals and organizations on our platform. If we find such individuals or organizations on Makebell, we will close their accounts.

CG.2.2 Threats and incitement to violence

We consider incitement to violence as advocating for, directing, or encouraging other people to commit violence. We do not allow threats of violence or incitement to violence on our platform that may result in serious physical harm.
CG.2.3 Violent and graphic content

Makebell is a platform that celebrates creativity but not shock-value or violence. We do not allow content that is gratuitously shocking, graphic, sadistic, or gruesome or that promotes, normalizes, or glorifies extreme violence or suffering on our platform. When there is a threat to public safety, we suspend or ban the account and, when warranted, we will report it to relevant legal authorities.
CG.2.4 Dangerous individuals and organizations

We remove such individuals and organizations, including mass murderers, serial killers and rapists, hate groups, criminal organizations, terrorist organizations, and other non-state armed groups that target civilians.
CG.2.4.1 Terrorist organizations

Terrorists and terrorist organizations are non-state actors that threaten violence, use violence, and/or commit serious crimes (such as crimes against humanity) against civilian populations in pursuit of political, religious, ethnic, or ideological objectives.
CG.2.4.2 Organized hate

Organized hate refers to those individuals and organizations who attack people based on protected characteristics, such as race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, or immigration status. We consider attacks to include actions that incite violence or hatred, dehumanize individuals or groups, or embrace a hateful ideology.
CG.2.4.3 Criminal organizations

Criminal organizations are transnational, national, or local groups that have engaged in serious crimes, including violent crimes (e.g., homicide, rape, robbery, assault), trafficking (e.g., human, organ, drug, weapons), kidnapping, financial crimes (e.g., extortion, blackmail, fraud, money laundering), or cybercrime.

CG.3 Harassment and bullying

We believe in an inclusive community and individualized expression without fear of abuse. We do not tolerate members of our community being shamed, bullied, or harassed and prohibit intimidation under our Terms of Service. Abusive content or behavior can cause severe psychological distress and will be removed from our platform. 

CG.3.1 Threats of hacking, doxxing, and blackmail

Threatening to hack or dox with an intent to harass or blackmail another individual can cause serious emotional distress and other offline harm. We define doxxing as the act of collecting and publishing personal data or personally identifiable information (PII) for malicious purposes. We consider these online behaviors as forms of abuse and do not allow them on our platform.
CG.3.2 Sexual harassment

Sexual harassment involves unwanted or inappropriate sexual behavior directed at another individual. We do not allow content, including comments or advances, that sexually harasses others, regardless of user's intent, as such actions can cause great distress to targeted individuals.

CG.4 Hateful and harmful behavior

Makebell is a diverse and inclusive community that has no tolerance for discrimination. We do not permit content that contains hate speech or involves hateful behavior and we remove it from our platform. We suspend or ban accounts that engage in hate speech violations or which are associated with hate speech off the Makebell platform.

CG.4.1. Attacks on the basis of protected attributes

We define hate speech or behavior as content that attacks, threatens, incites violence against, or otherwise dehumanizes an individual or a group on the basis of the following protected attributes:
CG.4.2 Slurs

Slurs are defined as derogatory terms that are intended to disparage an ethnicity, race, or any other protected attributes listed above. To minimize the spread of egregiously offensive terms, we remove all slurs from our platform, unless the terms are re-appropriated, used self-referentially (e.g., in a song), or do not disparage.
CG.4.3.Hateful ideology

Hateful ideologies are those that demonstrate clear hostility toward people because of their protected attributes. Hateful ideologies are incompatible with the inclusive and supportive community that our platform provides and we remove content that promotes them. 
CG.4.4 Suicide, self-harm, and dangerous acts

We care deeply about the health and well-being of the individuals that make up our community.
We do not allow content depicting, promoting, normalizing, or glorifying activities that could lead to suicide, self-harm, or eating disorders. We also do not permit users to share content depicting them partaking in, or encouraging others to partake in, dangerous activities that may lead to serious injury or death.
However, we do support members of our community sharing their personal experiences with these issues in a safe way to raise awareness and find community support.

CG.5 Illegal activities and regulated goods

We work to ensure Makebell does not enable activities that violate laws or regulations. We prohibit the trade, sale, promotion, and use of certain regulated goods, as well as the depiction, promotion, or facilitation of criminal activities, including human exploitation. Content may be removed if it relates to activities or goods that are regulated or illegal in the majority of the region or world, even if the activities or goods in question are legal in the jurisdiction of posting.
Criminal activities
Criminal activities cover a wide spectrum of acts punishable by law, including theft, assault, human exploitation, counterfeiting, and other harmful behavior. To prevent such behavior from being normalized, imitated, or facilitated, we remove content that promotes or enables criminal activities.

CG.5.1 Weapons
We do not allow the depiction, promotion, or trade of firearms, ammunition, firearm accessories, or explosive weapons. We also prohibit instructions on how to manufacture those weapons. Content as part of a museum's collection, carried by a police officer, in a military parade, or used in a safe and controlled environment such as a shooting range may be allowed.
CG.5.2 Drugs, controlled substances, alcohol, and tobacco
We do not allow the depiction, promotion, or trade of drugs or other controlled substances. The trade of tobacco and alcohol products is also prohibited on the platform.
CG.5.3 Frauds and scams
We do not permit anyone to exploit our platform to take advantage of the trust of users and bring about financial or personal harm. We remove content that deceives people in order to gain an unlawful financial or personal advantage, including schemes to defraud individuals or steal assets.
CG.5.4 Gambling
We do not allow content promoting gambling services, or that could be perceived as advertising for casinos, sports betting, or any other commercial gambling activity. 
CG.5.5 Privacy, personal data, and personally identifiable information (PII)
We do not allow content that violates the confidentiality of personal data or personally identifiable information (see our Privacy Policy).

CG.6 Minor safety

We are deeply committed to ensuring the safety of minors on our platform. We do not tolerate activities that perpetuate the abuse, harm, endangerment, or exploitation of minors on Makebell. Any content, including animation or digitally created or manipulated media, that depicts abuse, exploitation, or nudity of minors is a violation on our platform and will be removed when detected.
Users must meet the minimum age requirements to use Makebell, as stipulated in our Terms of Service. When underage account holders signed in without a parent or educators are identified, we will remove those accounts. Our platform is designed with the safety of minors in mind and some of our features are age restricted.

CG.6.1 Sexual exploitation of minors 
Makebell will take action on any content or accounts involving sexual interactions and advances between an adult and a minor, or between minors with a significant age difference.
Grooming behaviors are those in which an adult builds an emotional relationship with a minor in order to gain the minor's trust for the purposes of future or ongoing sexual contact, sexual abuse, trafficking, or other exploitation. These behaviors include: flattery, requests for contact on or off platform, requests for personal information, solicitation of minor sexual abuse material, sexual solicitations or comments, and gift-giving.
CG.6.2 Harmful activities by minors
Harmful minor activities include the possession or consumption of substances prohibited for minors, the misuse of legal substances, engagement in illegal activities, participation in activities, physical challenges, or dares that may threaten the well-being of minors. We will remove any such content from our platform.
CG.6.3 Physical and psychological harm of minors
Behaviors that place minors at risk of physical or psychological harm include physical abuse, neglect, endangerment, and psychological disparagement. We remove any such content from our platform. 
CG.6.4 Crimes against children
We do not allow users who have been convicted of crimes against children to have an account on our platform. These crimes include: sexual assault, molestation, murder, physical abuse or neglect, abduction, international parental kidnapping, trafficking, exploitation of minors for prostitution, live online sexual abuse of a minor, sexual exploitation of minors in the context of travel and tourism, attempts to obtain or distribute child sexual abuse material (CSAM), and the production, possession, or distribution of child sexual abuse material (CSAM). If we discover any such users, we ban the account. Any self-disclosed user information that states the account holder is a pedophile or minor sex offender will be taken at face value and the account may be deleted.

CG.7 Nudity and sexual activities

We strive to create a platform that feels welcoming and safe. We do not allow nudity, pornography, or sexually explicit content on our platform. We also prohibit content depicting or supporting non-consensual sexual acts, the sharing of non-consensual intimate imagery, and adult sexual solicitation.

CG.7.1 Sexual exploitation
Sexual exploitation is defined as any actual or attempted abuse of a position of vulnerability, power, or trust for sexual purposes, including profiting monetarily, socially, or politically from the sexual exploitation of another. We do not permit sexually exploitative content.

CG.8 Integrity and authenticity

We believe that trust forms the foundation of our community. We do not allow activities that may undermine the integrity of our platform or the authenticity of our users. We remove content or accounts that involve spam or fake engagement, impersonation, misleading information that causes harm, or that violate any intellectual property rights.

CG.8.1. Spam and fake engagement
Fake engagement includes any content or activity that seeks to artificially inflate popularity on the platform. We prohibit any attempts to manipulate the platform to increase interaction metrics. 
CG.8.2 Impersonation
We do not allow accounts that pose as another person or entity in a deceptive manner as per our Terms of Service. When we confirm a report of impersonation, we will ask the user to revise the profile or suspend or ban the account. We do allow parody, commentary, or fan accounts, as long as the user indicates in the bio and username that it is fan, commentary, or parody and not affiliated with the subject of the account.
CG.8.3 Misinformation

Misinformation is defined as content that is inaccurate or false. While we encourage our community to have respectful conversations about subjects that matter to them, we do not permit misinformation that causes harm to individuals, our community, or the larger public regardless of intent.
CG.8.4 Intellectual property violations
Please adhere to the guidelines set forth in our Intellectual Property Policy

CG.9.Platform security

Our policies and Terms of Service prohibit any activities that undermine the security and reliability of the Makebell service.

Intellectual Property Policy

Makebell respects the intellectual property rights of others, and we expect you to do the same. Makebell’s Terms and Community Guidelines do not allow posting, sharing, or sending any content that violates or infringes someone else’s copyrights, trademarks or other intellectual property rights.

IP.1 General Note

As a Makebell user, you are responsible for the content you post. If you have questions about copyright law or trademark law, such as questions about whether your content or your use of another person’s name or brand infringes or otherwise violates another person’s rights, you may want to contact a qualified legal professional. If you are unsure whether the material you plan to report to us is infringing or otherwise violating another person’s right, you may also want to first seek legal advice before reporting such content to us.

IP.2 Copyright

Copyright is a legal right that protects original works of authorship (e.g., music, videos, etc.). Generally, copyright protects an original expression of an idea (e.g., the specific way a video or music is expressed or created) but does not protect underlying ideas or facts.

IP.2.1 Copyright Infringement
We do not allow any content that infringes copyright. The use of copyrighted content of others without proper authorization or legally valid reason may lead to a violation of Makebell's policies.
At the same time, not all unauthorized uses of copyrighted content constitute an infringement. In many countries, exceptions to copyright infringement allow the use of copyrighted works under certain circumstances without authorization. These include the fair use doctrine in the United States and permitted acts of fair dealing in the European Union (and other equivalent exceptions under applicable local laws in other countries).
IP.2.2 Removal of Content; Suspension or Termination of Account
Any user content that infringes another person’s copyright may be removed. The account may be suspended or terminated for multiple copyright violations in connection with the use of the Makebell site or app, or other violations of the Terms and Community Guidelines. We reserve the right to refuse any account holder whose account was used for improper activities from opening a new account on Makebell’s site or app, or otherwise hosted by Makebell.
IP.2.3Information for Rightsholders:
IP.2.3.1 Copyright Infringement Notification
Contacting the user directly may resolve your complaint more quickly and in a way that is more beneficial to you, the user, and our community. You may also contact us at info@ricciwawa.com and indicate you wish to file a Copyright Infringement Report to request the removal of the alleged infringing content from Makebell.
All complaints should contain the information requested in our online Copyright Infringement Report form. Failure to include necessary information may limit our ability to investigate your claims and may result in your complaint being denied.
We may provide the account holder with your contact information, including the email address and the name of the copyright owner, and/or details of the complaint.
Before submitting a notification, please be aware that intentionally submitting a misleading or fraudulent report may lead to legal liability.
If you submit a report or infringement notification to us, we may contact you if we have additional questions about your report or notification. Please note that Makebell is not in a position to adjudicate disputes between third parties, and may not be able to remove the content or suspend the account you reported. As an alternative, you may want to contact the person who posted the content or owns the account to try to resolve your issue directly.
IP.2.3.2 Information for Users: Copyright Infringement Counter-Notification
If you receive a copyright infringement notification that you believe to be in error or believe that you are authorised to use the content, you can reach out to the copyright owner directly to request a retraction.
You may also contact us at info@ricciwawa.com and indicate you wish to file a counter-notification. All counter-notification should contain the information requested in the Counter Notification Form we will send you. Failure to include necessary information may limit our ability to investigate your claims and may result in your counter-notification being denied.
If we do not receive notice that the original reporter is seeking a court order to prevent further infringement of the material at issue, we may replace or cease disabling access to the material that was removed if the material does not infringe on third-party copyright. The decision to re-post any material is at Makebell’s sole discretion.
In order for any use of copyrighted work to come within an exception or limitation it must be fair, this means that it should, where applicable: (i) be no longer than necessary; (ii) be accompanied by sufficient acknowledgement of the source material and (iii) not unreasonably harm the legitimate interests of the rights holder.
Content that falls within an exception or limitation to copyright are still subject to our Community Guidelines. This means that such Content should not contain hate speech or involve hateful behavior or be used to abuse, mock, humiliate, embarrass, intimidate, or hurt any person.
Please note that in accordance with its legal obligations Makebell provides to users and rights holders a copyright infringement dispute resolution mechanism, however users remain free to assert their rights in court.

IP.3 Trademark

A trademark is a word, symbol, slogan, design, or combination of any of the foregoing that identifies the source of a product or service and distinguishes it from other products or services.

IP.3.1 Trademark Infringement
Trademark laws prohibit trademark infringement, which is generally the unauthorized use of a trademark or service mark in connection with goods or services in a way that is likely to cause confusion, deception or mistake about the source, origin, sponsorship or affiliation of the associated goods and/or services. 
At the same time, the use of another’s trademark for purposes of accurately referencing, lawfully commenting, criticizing, parodying, or reviewing the trademark owner’s products or services, or for purposes of comparing them to other products or services, where the mark is not used to designate the user’s own goods or services or those of a third party, is generally not considered a violation of our policies. Likewise, it is generally permissible to make a fan page about a brand, even without the brand’s permission, provided that you do not claim to speak for or be associated with the brand or otherwise violate the brand’s intellectual property rights. 
IP.3.2 Removal of Content; Suspension or Termination of Account
Any content that violate another’s trademark rights may be taken down. Repeat violations of trademark rights in connection with the use of the Makebell site or app, or other violations of the Terms and Community Guidelines may result in the suspension or termination of the user account. We reserve the right to refuse any account holder whose account was used for improper activities from opening a new account on Makebell’s site or app, or otherwise hosted by Makebell.
